RENTAL AGREEMENT & TERMS AND CONDITIONS

LEGALLY BINDING AGREEMENT

This Rental Agreement (“Agreement”) is a legally binding contract between AJN Trailer Rentals (“Company,” “we,” “us,” or “our”) and the renter (“Renter,” “you,” or “your”).

By electronically signing, checking any acceptance box, submitting payment, taking possession of the trailer, towing the trailer, or otherwise using the trailer, Renter acknowledges that they have read, understood, and voluntarily agreed to all terms and conditions contained in this Agreement.

1. DEFINITIONS

“Agreement” means all terms and conditions contained herein, including any electronic communications, invoices, checkout pages, acknowledgments, policies, or supplemental documents provided by AJN Trailer Rentals.

“You” or “your” means the renter, any authorized driver, and any individual or entity responsible for payment or use of the trailer.

“We,” “our,” or “us” means AJN Trailer Rentals.

“Trailer” means the rented non-motorized trailer and all included equipment, accessories, straps, ramps, spare tires, locks, tools, or substituted equipment.

“Loss of Use” means the inability of AJN Trailer Rentals to rent the trailer due to damage, theft, impoundment, repair, or loss.

“Diminished Value” means the reduction in market value of the trailer following damage, whether repaired or unrepaired.

2. CONTACTLESS RENTAL ACKNOWLEDGMENT

Renter acknowledges and agrees that AJN Trailer Rentals may utilize fully contactless rental procedures including but not limited to:

Lockbox pickup and return
Remote identity verification
GPS-based pickup instructions
Electronic communications
Remote trailer inspection procedures
Electronic delivery of rental instructions and documents

Renter expressly certifies and agrees that they:

Know how to safely tow and operate a trailer
Understand proper trailer hookup and unhitching procedures
Know how to properly connect safety chains
Understand trailer brake and lighting connections
Understand trailer weight ratings and load securement
Understand proper cargo distribution and towing safety
Are physically and legally capable of towing the trailer

Renter assumes all responsibility for safe trailer operation.

AJN Trailer Rentals is not responsible for renter inexperience, towing errors, improper hookup, improperly secured cargo, driving ability, or failure to understand trailer operation.

Renter is required to take and submit four (4) clear photographs of the trailer prior to departure and upon return, including all sides of the trailer, as well as a clear photo showing the trailer properly hooked up to the towing vehicle with the coupler secured, safety pin locked, safety chains connected, breakaway cable connected, and trailer lights functioning. All required photos must be texted to the phone number provided by AJN Trailer Rentals before leaving with the trailer and immediately upon return. Failure to provide required photos may result in additional charges or liability for unreported damages.

3. ELECTRONIC SIGNATURE CONSENT

Pursuant to the New Jersey Uniform Electronic Transactions Act (N.J.S.A. 12A:12-1 et seq.), renter agrees that electronic signatures, digital acknowledgments, checkbox acceptance, online approvals, email confirmations, uploaded identification documents, text message confirmations, and electronic communications shall have the same legal force and effect as handwritten signatures.

Renter waives any claim contesting the validity or enforceability of electronically executed agreements.

4. DRIVER, AGE & TOW VEHICLE REQUIREMENTS

Renter certifies that:

• They are twenty-five (25) years of age or older at the time of rental

• They possess a valid driver's license

• The towing vehicle is properly rated for the trailer and intended cargo

• The towing vehicle is mechanically safe and roadworthy

• The towing vehicle contains functioning trailer wiring and lighting connections

• The towing vehicle is properly registered and insured

• The renter is legally authorized to tow the trailer

AJN Trailer Rentals does not rent trailers to individuals under twenty-five (25) years of age.

Providing false information regarding renter age or eligibility constitutes a material breach of this Agreement and may result in immediate cancellation of the rental without refund.

AJN Trailer Rentals reserves the right to refuse rental if towing equipment is deemed unsafe, improperly equipped, insufficient, or if renter eligibility requirements are not met.

5. INSURANCE REQUIREMENTS

Renter agrees to maintain valid automobile insurance covering trailer towing liability throughout the rental period.

Renter acknowledges and agrees:

Renter’s insurance coverage shall be primary
Renter assumes full financial responsibility for all damages, injuries, claims, liabilities, losses, theft, legal expenses, and trailer-related incidents arising from the rental
Renter remains fully liable for any uncovered losses, deductibles, exclusions, or denied insurance claims

Failure to maintain insurance constitutes a material breach of this Agreement.

6. GPS TRACKING DISCLOSURE

Renter acknowledges and consents that trailers may contain:

GPS tracking devices
Apple AirTags
Telematics systems
Theft recovery devices
Location monitoring systems

These systems may be used for:

Theft prevention
Asset recovery
Contract enforcement
Location verification
Mileage verification
Recovery of overdue or abandoned equipment

Tampering with, removing, disabling, damaging, shielding, or interfering with any tracking device is strictly prohibited and may result in:

Immediate termination of rental
Immediate repossession of equipment
Recovery fees
Civil liability
Criminal prosecution where permitted by law

7. CONDITION OF TRAILER

Renter acknowledges the trailer has been inspected and accepted in safe, satisfactory, and roadworthy condition.

Renter agrees to inspect:

Tires
Wheels
Lug nuts
Coupler
Hitch
Safety chains
Trailer lights
Wiring connections
Brakes
Ramps
Straps
Locks
Included equipment

before towing the trailer.

Failure to immediately report defects or concerns constitutes acceptance of the trailer’s condition.

8. PHOTO & VIDEO DOCUMENTATION

Renter agrees to provide timestamped photographs and/or videos documenting:(contactless only)

Trailer condition before departure
Hitch connection
Safety chains
Trailer lights
Tire condition
Trailer condition upon return

Failure to provide documentation constitutes acknowledgment that the trailer was received clean, safe, and undamaged.

9. RENTAL, INDEMNITY AND WARRANTIES

This is a contract for rental of the trailer. We may repossess the trailer at your expense without notice to you, if the trailer is abandoned or used in violation of law or this Agreement.

You agree to indemnify us, defend us and hold us harmless from all claims, liability, costs and attorney fees we incur resulting from, or arising out of, this rental and your use of the trailer.

We make no warranties, express, implied or apparent, regarding the trailer, no warranty of merchantability and no warranty that the trailer is fit for a particular purpose.

Renter agrees to indemnify, defend, and hold harmless AJN Trailer Rentals, its owners, employees, contractors, affiliates, and agents from all claims, lawsuits, liabilities, damages, losses, attorney fees, court costs, and expenses arising from renter’s possession, towing, loading, operation, or use of the trailer.

This Agreement constitutes a contract for trailer rental only.

AJN Trailer Rentals makes no warranties, express or implied, including no warranty of merchantability or fitness for a particular purpose.

10. RESPONSIBILITY FOR DAMAGE OR LOSS

You are responsible for all damage to, or loss or theft of, the trailer, including damage caused by weather, road conditions and acts of nature, whether or not you are at fault.

You are responsible for the cost of repair or the actual retail cash value of the trailer if it is not repairable or if we elect not to repair it.

You are also responsible for:

Loss of Use
Diminished Value
Missing equipment
Administrative expenses
Trailer damage
Tire damage
Wheel damage
Theft
Vandalism
Cargo loss
Improper loading damage
Improper hookup damage
Overloading damage
Toll violations
Parking violations
Traffic citations
Impound fees
Storage fees
Recovery costs
Loss of rental income

whether or not renter is at fault.

Renter must report all accidents, thefts, or damage involving the trailer to AJN Trailer Rentals and law enforcement within 24 hours of occurrence.

11. PROHIBITED USES

The following uses of trailer are prohibited:

Transporting dangerous or hazardous materials
Illegal activity
Towing while impaired by drugs or alcohol
Allowing the trailer to be towed by unauthorized drivers
Use obtained through false, fraudulent, or misleading information
Overloading trailer capacity
Transporting passengers inside the trailer
Racing or reckless driving
Off-road use
Improperly secured cargo
Commercial hauling without authorization
Use outside the United States without written permission
Any use likely to damage the trailer
Placing signs, lettering, or paint on the trailer

Violation of prohibited uses constitutes a material breach of this Agreement.

12. PROVIDED EQUIPMENT & DAMAGE CHARGES

Renter acknowledges that the trailer may include equipment, accessories, tools, straps, winches, batteries, and related components provided by AJN Trailer Rentals.

Renter agrees that all provided items must be returned in the same condition in which they were received, excluding normal wear and tear.

Renter is financially responsible for any lost, stolen, damaged, destroyed, or missing equipment, including but not limited to the following replacement charges:

2 Axle Straps — $15 each
Solar trickle charger -- $40
4 Ratchet Straps — $15 each
Winch — $300
Winch Controller — $30
Battery — $150
Rear Jack Stands — $75 each

AJN Trailer Rentals reserves the right to charge renter’s payment method on file for repair or replacement costs of damaged or missing equipment.

13. CHARGES & PAYMENT AUTHORIZATION

Renter agrees to pay all amounts owed under this Agreement including but not limited to:

Rental charges
Late fees
Taxes
Toll violations
Parking violations
Traffic fines
Storage fees
Cleaning fees
Recovery expenses
Administrative fees
Chargeback fees
Attorney fees
Court costs
Damage claims
Loss of Use
Diminished Value

Renter authorizes AJN Trailer Rentals to charge any payment method on file for unpaid balances or damages.

A minimum $100 security deposit is required for all rentals.

14. LATE RETURNS, ABANDONMENT & RECOVERY

Late returns may incur additional daily rental charges.

If the trailer is abandoned, impounded, illegally parked, unrecoverable, or not returned as agreed, renter shall be responsible for:

Recovery expenses
Repossession costs
Storage fees
Legal fees
Collection costs
Lost rental income
Administrative expenses

AJN Trailer Rentals reserves the right to repossess the trailer without notice where permitted by law.

15. RELEASE OF LIABILITY

To the fullest extent permitted under New Jersey law, renter releases and holds harmless AJN Trailer Rentals, its owners, employees, contractors, affiliates, and agents from any and all claims, liabilities, injuries, damages, losses, attorney fees, or causes of action arising from:

Trailer use
Towing operations
Improper hookup
Improper loading
Cargo loss
Roadside incidents
Mechanical failure
Tire failure
Weather conditions
Negligence of renter
Property damage
Personal injury
Death

except in cases of gross negligence or intentional misconduct by AJN Trailer Rentals.

16. NO CONSEQUENTIAL DAMAGES

AJN Trailer Rentals shall not be liable for any consequential, incidental, indirect, special, or punitive damages including but not limited to:

Lost income
Missed appointments
Business interruption
Cargo loss
Delayed deliveries
Travel expenses
Hotel expenses
Towing expenses

arising from trailer use, mechanical issues, delays, or breakdowns.

17. GOVERNING LAW & VENUE

This Agreement shall be governed exclusively by the laws of the State of New Jersey.

Any dispute, claim, or legal proceeding arising from this Agreement shall be brought exclusively in a court located within the State of New Jersey.

Renter consents to jurisdiction and venue within New Jersey.

18. WAIVER & SEVERABILITY

Failure by AJN Trailer Rentals to enforce any provision of this Agreement shall not constitute a waiver of any rights.

If any provision of this Agreement is deemed invalid or unenforceable, all remaining provisions shall remain fully enforceable.

19. ENTIRE AGREEMENT

This Agreement constitutes the complete and entire agreement between the parties and supersedes all prior representations, communications, or agreements.

No modification shall be valid unless made in writing and signed by AJN Trailer Rentals.

ACKNOWLEDGMENT & ACCEPTANCE

By electronically signing, checking any acceptance box, submitting payment, or taking possession of the trailer, renter acknowledges and agrees that:

• They have read and understood all terms and conditions

• They voluntarily agree to all terms and conditions

• They are 25 years of age or older

• They know how to safely operate and tow a trailer

• They know how to properly hook up and unhitch a trailer

• They possess valid insurance coverage

• They accept full responsibility for trailer use

• Their electronic acceptance constitutes a legally binding signature

ELECTRONIC ACCEPTANCE

By checking any acceptance box, electronically signing, submitting payment, taking possession of the trailer, or using the trailer, renter acknowledges and agrees that:
